EMPLOYMENT AGREEMENT

The client hereby employs and authorizes the agency or its agents to conduct an appropriate

service in the client’s behalf at an agreed rate, as set forth and enumerated in all oral, written and e-mail communication.  The client agrees to identify any other agencies that were engaged prior to the tenure of this company, and the client agrees not to divulge any information received from this agency until the assignment is completed, attesting to the accuracy of the information supplied.  Justice Incorporated handles all its matters as confidential, and subject to the work product protection act.  It is agreed that Justice Incorporated will not disseminate any information provided the company or its agents which by means of such dissemination to unauthorized persons would compromise the integrity of the service.

The agency hereby agrees to conduct the services in an expeditious manner, in the interest of the client, incurring expenses judiciously, and will report when requested, on matters pertinent to the service, to the client or legal representatives, but where the service is concluded, or terminated by the client or agency, a demand will be made for compensation to satisfy the client’s obligations before the final report and affidavits are filed or released.

Client agrees to allow Justice Incorporated to conduct the service at its sole discretion via any lawful means it deems to be appropriate.

A detailed statement of charges itemizing a clear explanation of the nature and duration of tasks performed on behalf of the client will be communicated to the client.

Statement balances will be paid in full unless otherwise agreed to by the parties negotiating the contract in
writing.  The taking of depositions and court testimony will be considered part of the service agreement and
Is payable at the hourly rate.

The party and or its representatives requesting service agree to satisfy and pay the account immediately or if agreed to by both parties with thirty days from the date of invoice, and to pay a finance charge of Nine Percent (9%) per month, which is an Annual Percentage Rate of One Hundred Eight Percent (108%) APR), on all accounts unpaid after thirty (30) days.

The agency’s rate outside of the actual service rate will be billed at $65.00 per hour, and the agency will not exceed the agreed terms without having first obtained the approval of the client. 

Should any of the provisions of this agreement be subject to question or be litigated to compel enforcement by judicial authority the client agrees to pay all costs or collection, including attorney’s fees in a sum equal to Fifty Percent (50%) of all sum’s due and owing to Justice Incorporated, on said account, and court costs, in the event of default in the repayment of said account.  The client further agrees to waive their entire right to Homestead or any other exemption as set forth by statute.  The undersigned waive all claims as to proper venue for the hearing of any matter under this agreement and agree that the City of Winchester, Virginia, will be proper venue for hearing any claim hereunder.

The client, client’s heirs, beneficiaries, devises, legatees, administrators and assigns further agree to indemnify and hold harmless Justice Incorporated and/or it’s agents and employees from any and all actions, causes or actions, claims, damages, and demands or whatever type wherever situated arising directly or indirectly from the service of process which the client has requested.

JUSTICE INCORPORATED operates under the privileges and immunities of article IV, section 2 of the United States constitution, the commerce clause of article I, section 8 of the constitution, and the due process and equal protection clauses of the fourteenth amendment of the United States constitution, combining to secure the rights of any citizen of the State to travel into any other State for the purpose of engaging in lawful commerce, business or trade, without molestation, and maintain actions in the courts of the States.  All service will originate in, be conducted from, and conclude in our Virginia office.
